EIA ('EIA'/'we'/'us') respects the privacy and personal electronic communication of the users of the EIA Services (as defined below). Usage Statistics. EIA may also compile Personal Information and usage statistics such as usage patterns, travel patterns and website page views. EIA may use this information for statistical purposes to improve the EIA Services and to manage our networks and systems more efficiently. Individual users cannot be identified through these reports.

 

Cookies. EIA makes use of 'cookies,' in order to identify returning users and expedite your reconnection to the network. EIA recommends that all users familiarize themselves with their browsers, and learn to identify and understand the differences between secure and regular connections and be aware of the implications of transmitting personal information over an insecure connection.

 

Security Limits. Despite the security measures described above, EIA strongly recommends that its customers take measures to ensure the security of their data across ANY Internet connection. Like any high-speed service, including DSL and cable, the EIA Services are not inherently secure. We recommend the active use of security solutions such as personal firewalls, anti-virus software, virtual private networks and encryption, though we do not provide these solutions for our users and cannot guarantee their effectiveness. It is the user's responsibility to evaluate their personal needs and workplace requirements, and obtain and properly configure appropriate security measures.

 

Tracking Unlawful Use of EIA Services. On occasion, it may be necessary to record and trace individual usage and/or personal or technical information in order to maintain the integrity and security of the EIA Services. In order to protect our users and maintain a high level of service, EIA will use commercially reasonable efforts to track and identify any malicious user in contravention of our Terms of Service. To that end, EIA or its representatives may track and record any information that may be considered evidence of misuse.

 

Advertisements: Advertisements appearing through the EIA Services may be delivered by us or one or more third-party web advertisers. These third party web advertisers may set cookies. These cookies allow the advertisement server operated by that third party to recognize your device each time they send you an online advertisement. With whom does EIA share my Personal Information?

Is the free Wi-Fi limited?

Each session is limited to a maximum of 30 minutes but you can have an unlimited number of sessions every day. This means that you will need to log out and log back in every 30 minutes.

 

My email program seems to have problems sending email when I’m connected to a public Wi-Fi hotspot.

E-mail that is being sent is handled with a setting called an SMTP server. Your settings may be set to your Internet Service Provider at home and therefore may not work when not connected to that specifc ISP provider. We recommend sending email through a corporate VPN connection, browser-based web-mail, or a secure connection to your mail provider.

 

Can I access my corporate network?

You can seamlessly access your corporate network, including your company e-mail and calendar, when you have set up your device with VPN (virtual private network) client software and the necessary security credentials.

'Location' means an airport, mall, store or other property where EIA Services are provided to persons who have accepted these Terms;

 

SERVICE TERMS

Service Use. The EIA Services are intended for personal use only use by permitted users at a Location, and are not intended for business purposes or processes. EIA will use commercially reasonable efforts to provide access to the EIA Services to you, however you acknowledge that EIA cannot guarantee that wireless access will be available at all Locations, all of the time or that access will be at any particular bandwidth rate.

 

MAC Addresses & Personal Information. By accessing or using the EIA Services, you acknowledge that the EIA Services record and retain the MAC (Media Access Controller) address from the network card in or used with your computer or other device. EIA will use your MAC address in accordance with its data policies as further described in the Privacy Policy. The Privacy Policy also sets out the terms on which EIA collects and uses other information about users of the EIA Services.

 

Content Filtering and Service Control. EIA may prioritize, restrict, block, or otherwise set limits (such as bandwidth allocations, or limits on types of content accessed or transferred) on your use of the EIA Services for certain applications and/or websites. This may impact the functioning of high bandwidth applications and/or websites, and/or prevent you from accessing such applications and/or websites. EIA Services are subject to unavailability, including emergencies, third party service failures, transmission, equipment or network problems or limitations, interference, signal strength, maintenance and repair, and national security issues, and may be interrupted, refused, limited, or curtailed. In addition, EIA and the owner or operator of the property at which you are accessing the EIA Services may implement URL filtering or other content filtering which block access to certain websites or content while at the property ('Content Filtering'). You acknowledge and agree that EIA and the property at which you are accessing the EIA Services will have no liability for such Content Filtering and will not be liable to you for any acts, omissions, performance or non-performance related to the Content Filtering.

 

Security. EIA does not guarantee the privacy of any transmission you make through the EIA Services or the security of your device or equipment against viruses or other malicious code. You should have no expectation of privacy from third parties when transmitting information through the EIA Services. Monitoring. EIA retains the right to monitor the EIA Services from time to time and to disclose any information as necessary to: (i) satisfy any law, regulation or other governmental request or to assist in the pursuit of any legal action against you or other end users; (ii) to operate the EIA Services properly; and/or (iii) to ensure or enforce compliance with these Terms or to protect EIA or EIA’s other customers or otherwise protect EIA, its users or the general public. Passwords. Any unauthorized use or breach of these Terms by a third party to whom you disclose your password (intentionally or inadvertently) may be treated as a breach by you of these Terms.

 

Acceptable Use Policy. EIA Remedies. Without prejudice to EIA’s other rights and remedies, EIA may take any one or more of the following actions in response to breaches of these Terms: (i) issue warnings, written or oral; (ii) suspend your account or your access to the EIA Services; (iii) terminate your account or the Services (as applicable); or (iv) bring legal action to prevent violations and/or to collect damages EIA is legally entitled to, if any, caused by violations.

 

CONTENT TERMS

EIA Content. All right, title, and interest in and to the EIA Services are and will remain the exclusive property of EIA and its licensors. Nothing in these terms gives you a right to use the EIA name or any of the EIA trademarks, logos, domain names, or other distinctive brand features.

 

EIA Software. Any software that may be made available by EIA in connection with the EIA Services ('Software') contains proprietary and confidential information that is protected by applicable intellectual property and other laws. Subject to the terms and conditions of these Terms, EIA hereby grants you a personal, non-transferable, non-sublicensable and non-exclusive right and license to use the object code of any Software on a single device solely in connection with the EIA Services, provided that you shall not (and shall not allow any third party to) copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code or sell, assign, sublicense or otherwise transfer any right in any Software. You agree not to access the EIA Services by any means other than through the interface that is provided by EIA for use in accessing the EIA Services. Any rights not expressly granted herein are reserved and no license or right to use any trademark of EIA or any third party is granted to you in connection with the EIA Services.

 

User Content and Account. You are solely responsible for your use of the EIA Services, for any content you provide through the EIA Services, and for any related consequences, including liability for any loss or damage resulting, directly or indirectly, from your making any material or information available through the EIA Services. You are responsible for maintaining the confidentiality of your login, password and account and for all activities that occur under your login or account. EIA AND ITS AFFILIATES, PARTNERS AND SUPPLIERS EXPRESSLY DISCLAIM ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, NON-INFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE. Limitation of Liability. THESE LIMITATIONS APPLY REGARDLESS OF WHETHER THE PARTY LIABLE OR ALLEGEDLY LIABLE WAS ADVISED, HAD OTHER REASON TO KNOW, OR IN FACT KNEW OF THE POSSIBILITY OF SUCH DAMAGES. YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT EIA SHALL NOT BE LIABLE FOR ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF ANY USER, INCLUDING YOU.

 

Indemnification. You agree to defend, indemnify and hold harmless EIA from and against all claims, liability, and expenses, including all legal fees and costs, arising out of: (i) your breach of any provision of these Terms; or (ii) the placement or transmission of any information or other materials through the EIA Services made by you or others using your account. EIA reserves the right, in its sole discretion and at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. You agree to co-operate as fully as reasonably required in the defense of any claim.

 

GENERAL TERMS.

Governing Law. Any disputes arising hereunder shall be governed as follows: if you are accessing EIA Services in the USA, exclusively by the laws of the State of Delaware; if you are accessing EIA Services from a Location in Canada, the laws of the Province of Ontario and the laws of Canada applicable therein will apply, without giving effect to their conflict of laws principles. If you are a user of the EIA Services in Canada You expressly consent to the exclusive forum, jurisdiction, and venue of the courts of Ontario to resolve any disputes. If you are a user of the EIA Services in the USA, You expressly consent to the exclusive forum, jurisdiction, and venue of the courts of Delaware to resolve any disputes.

 

Waiver and Severability. No waiver of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. If any provisions contained herein shall be determined to be void, invalid, or otherwise enforceable by a court of competent jurisdiction, such termination shall not affect the remaining provisions contained herein.

 

Entire Agreement; Changes to Terms. These Terms and the EIA Privacy Policy are the entire agreement between EIA and you regarding the EIA Services. These Terms supersede and replace any prior agreements between EIA and you regarding the EIA Services. EIA may revise these Terms from time to time and the most current version will always be available here. By continuing to access or use the EIA Services after those revisions become effective, you agree to be bound by the revised Terms. If any change to these Terms is not acceptable to you, your only remedy is to stop accessing and using the EIA Services. You may not assign these Terms without the prior written consent of EIA, but EIA may assign or transfer these Terms, in whole or in part, without restriction.

 

Suspension and Termination. If you are dissatisfied with the EIA Services or with these Terms or our Privacy Policy, your sole and exclusive remedy is to discontinue using the EIA Services. These Terms shall survive any such termination. EIA reserves the right in its sole discretion to suspend or terminate your account and/or access to the EIA Services at any time with or without prior notice in the event that: (a) you have violated these Terms; or (b) you fail to pay any charges when due. EIA may suspend the operation of the EIA Services for repair or maintenance work or in order to update or upgrade the contents or functionality of the EIA Services from time to time. EIA also reserves the right to modify or discontinue, temporarily or permanently, the EIA Services (or any part thereof). EIA shall not be liable to you or any third party for any modification, suspension or discontinuation of the EIA Services.

 

YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND UNDERSTAND THE RIGHTS, OBLIGATIONS, TERMS AND CONDITIONS SET FORTH HEREIN. BY USING THE EIA SERVICES YOU EXPRESSLY CONSENT TO BE BOUND BY THESE TERMS AND CONDITIONS.
